Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
ELIGIBILITY: The Park ‘N Fly Park ‘N Drive Employee Win-a-Car Sweepstakes (the “Sweepstakes”) is open only to individuals who are (a) legal residents of the 50 United States or DC, (b) at least 18 years of age, and (c) employed by Park ‘N Fly (“Sponsor”) for at least six (6) months as of the end of the Sweepstakes Period (defined below) – that is, you must be employed by Park ‘N Fly as of 1/1/2022, and remain in such employment through 6/30/22 to be eligible. Without limitation, lot managers, lot assistant managers, and all other corporate and field employees are eligible (part-time employees working an average of 20 hours per week are included), but not members of Park ‘N Fly’s Executive team, Director level or contract employees or vendors. Employees of Park DIA in Denver, a lot managed and operated by Park ‘N fly, also are eligible for the Sweepstakes, as long as Park ‘N Fly continues to manage and operate that lot through the end of the Sweepstakes Period. The Sweepstakes is subject to all applicable laws. Void outside the U.S. and where prohibited.
SWEEPSTAKES PERIOD: The Sweepstakes begins August 1st 2021, and ends June 30, 2022. Future similar drawings may occur in later years, but each subsequent drawing, if any, will be separate and subject to its own Official Rules. Any future offering is in Sponsor’s discretion, and no guarantee is made about similar offers in future years.
HOW TO ENTER: Each eligible person employed with Park ‘N Fly as of 1/1/22 and still employed by the end of the Sweepstakes Period of June 30th 2022 is automatically entered into the Sweepstakes grand prize drawing. Limit one (1) entry per eligible employee.
DRAWING AND WINNER NOTIFICATION: One (1) winner will be selected at random, on or about June 30th, 2022, from among all eligible employees who were entered into the Sweepstakes grand prize drawing.
By accepting any prize, you agree to be bound by these Official Rules and all decisions of the judges, which are final and binding in all matters relating to the Sweepstakes. Any potential winner will be notified using the contact information associated with their HR file with Park ‘N Fly. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential winner does not respond within five (5) days after the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Potential winner may be required to execute a Declaration of Compliance, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”). Failure to return any Prize Claim Documents when requested may result in forfeiture of the prize and selection of an alternate winner. If any eligible winner is not of legal age of majority in his or her state of residence, at Sponsor’s option, the applicable prize either may be awarded in the name of parent or legal guardian of winner, or parent or legal guardian of winner may be required to ratify and sign all Prize Claim Documents.
PRIZE/ODDS: One (1) grand prize is available: The winner’s choice of either a NEW Ford Bronco Sport (either a 2021 or 2022 Model in Sponsor’s discretion) (approx. retail value $30,000), or $30,000. Color and options for vehicle are in Sponsor’s discretion. Any additional or special features of vehicle requested by winner are at winner’s expense. Any depiction of vehicle in advertising is for illustration only, and actual vehicle may not match depiction(s). Arrangements for delivery of vehicle will be made via a dealership in winner’s area as determined in Sponsor’s discretion. Manufacturer’s standard limited warranty applies to the prize. Sponsor will pay delivery charges, sales tax, and initial registration fees. Winner is responsible for all other costs of owning, operating, maintaining, insuring, registering, and operating the vehicle, as well as for possessing a valid driver’s license and payment of any and all other taxes that may become due as a result of accepting the prize, including by not limited to all applicable local, state and federal income taxes. Value of vehicle will be reported as income on the winner’s Form W-2 reported to the IRS with all required deductions taken; provided that, if winner selects the vehicle, an additional true-up payment will be included for purposes of estimated federal, state, local income tax and other employee tax withholding due as a result of accepting the vehicle prize.
General Prize Conditions: Any employee who wins the grand prize in this sweepstakes will be ineligible for any future similar drawing Park ‘N Fly may offer for the next five (5) years. No transferring of prize, prize substitution, or cash equivalent of any prize is permitted, except in Sponsor’s discretion. Sponsor reserves the right to substitute a prize with one of equal or greater value in the event an advertised prize becomes unavailable. Any difference between the actual value of any prize and the approximate retail value set forth in these official rules may not be claimed and will not be awarded. Allow 8-10 weeks after winner verification for prize delivery.
Odds: Odds of winning depend on the number of eligible employees at the end of the Sweepstakes Period.
PUBLICITY/USAGE RIGHTS: Except where prohibited, acceptance of any prize constitutes the winner’s consent for use of his/her name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).
RELEASE OF LIABILITY: You agree that Sponsor, its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Sweepstakes, and officers, directors, or agents of any of the foregoing (“Sweepstakes Entities”): (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, receipt, possession and/or use or misuse of any prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.
You further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses. These rules and any disputes relating hereto are governed by the internal laws of the State of Georgia, without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in the State of Georgia for resolution of any disputes relating to the Sweepstakes and waive any objection thereto.
ADDITIONAL RULES: No responsibility is assumed for any damage to your mobile device or computer system which is occasioned by participating in the Sweepstakes, or for any computer system, mobile device, hardware, software or program malfunctions, or other errors, failures or delays. Without limiting the generality of the foregoing, no responsibility is assumed for incomplete, illegible, misdirected, misprinted, forged, tampered with, altered, late, lost, damaged, or stolen submissions, prize notifications or other Sweepstakes materials, all of which are void; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
Any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, may be disqualified, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner from all eligible, non-suspect entries unaffected by the problem.
DATA: In connection with your employment with Park ‘N Fly, you agree to Sponsor’s manner of collection and usage of any personal information you submit, all of which is subject to Sponsor’s Privacy policy. California residents may review Sponsor’s California Privacy policy for additional information regarding collection of personal information and Sponsor’s privacy practices.
